Gift Certificate Terms & Conditions

1. Redemption. Best American Arts® Gift Certificates can only be redeemed through the www.BestAmericanArts.com web site toward the purchase of American art which are then deducted from the balance on the Gift Certificate. Any unused balance will be stored under the same Gift Certificate number. If an order total exceed the balance available in the Gift Certificate, an acceptable credit card must be charged at the time of redemption. To check a Gift Certificate balance or to ask a question, please send an email to CustomerCare@BestAmericanArts.com.

2. Gift Certificates cannot be used to purchase other Gift Certificates or for special orders from our American artisans.

3. A Coupon Code cannot be used to purchase a Gift Certificate, but a Coupon code can be sued at the end of the online checkout when using a Gift Certificate as payment.

4. Gift Certificates cannot be reloaded, redeemed for cash, resold or transferred for value of any kind or applied to any other account, except to the extent required by law. Unused Gift Certificate balances under a particular number may not be transferred. However, Best American Arts may, in its discretion, extinguish an used balance of a particular Gift Certificate by refunding the unused balance to the credit card on file of the original purchaser.

5. Gift Certificates purchases and uses are subject to our Security & Privacy Policy and these and our other Terms and Conditions of web site use then in effect and to the extent permitted by law. Best American Arts reserves the right to change these policies from time to time. We may provide gift recipients information about the web site and the Gift Certificate and may provide Gift Certificate purchasers with the status of the Gift Certificate purchased.

6. Fraud or Deceit. Best American Arts has the right to close an account or require alternative payment methods if a Gift Certificate appears to have been obtained or used to obtain goods by fraud or deceit.

7. Risk of Loss. The risk of loss and title for Gift Certificates pass to the purchaser upon Best American Arts electronic transmission to the recipient at the email address provided by the purchaser. We are not responsible for any lost or stolen Gift Certificates or other misuse.

8. Limitation on Liability. BEST AMERICAN ARTISTS AND ARTISANS, INC., AN OHIO CORPORATION, D/B/A BEST AMERICAN ARTS, MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE GIFT CERTIFICATES, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. IN THE EVENT A GIFT CERTICATE OR ITS ALPH-NUMERIC CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CERTIFICATE. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS, EXCLUSIONS OR DISCLAIMERS MAY NOT APPLY TO YOU AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
